EMERGENCY MILITARY TRIBUNALS AUTHORIZED
Authorization of trial court authority in military tribunals convened by commanding officers in the field dispatched to enforce federal law. The Constitution is silent regarding the continuity of the federal judiciary during an emergency. If local interruptions occurs, courts could move to unaffected areas, or reassign cases to other districts or circuits. In severe situations, where federal courts are extensively interrupted, the President might declare martial law and vest trial court authority in military tribunals convened by commanding officers in the field. Congress has not legislated for situations of extended interruption of the civilian judiciary.
